Welcome to EasyTour. By accessing and using this website and the services it provides ("EasyTour"), you agree to these terms and conditions. If you do not accept these terms and conditions, you must refrain from using the website and the services.

EasyTour reserves the right to amend these terms and conditions from time to time. Unless otherwise stated, amendments will be effective immediately when we post them on this website. You are responsible for ensuring you are familiar with the latest terms and conditions. Your continued use of the website and/or services represents your agreement to be bound by the latest terms and conditions as amended.

We reserve the right to amend or remove information published on or through the website if we consider it incorrect or misleading, or if we consider your action towards guests is inappropriate.

 

DEFINITIONS

In these terms and conditions, the following expressions are used:

‘EasyTour’ refers to the website but can also refer to EasyTour Ltd.

‘Member’ means anyone who has registered on our website.

‘Owner’, ‘Host’ refers to homeowner.

‘Guest’ is referring to traveler.

‘Accommodation provider’ means the Owner (if owner-managed) or Owner’s representative (family member, friend, agent or property manager).

‘Services’ means one or more service offerings provided by us.

‘We’, ‘us’ and ‘our’ are referring to EasyTour Ltd.

‘You’ and ‘Your’ refer to you.

‘Listing’ means a property listing (advertisement) on our website.

‘Rental Contact’ refers to the individual acting as primary contact for rental activities for a property.

‘Content’ refers to any text or images on the website either viewable by the public, or in private member areas of the website.

 

1. GENERAL TERMS OF USE

1.1 You may only use our service if you can form a legally binding contract that is enforceable against you. You must be at least 18 years old.

1.2 You agree to provide complete, accurate and current information when listing or booking accommodation. We use and store your information in accordance with our Privacy Policy.

1.3 Accuracy and availability of information:  You accept that the website is provided on an “as is” and “as available” basis and your use of the service is at your sole risk.  We make no warranties as to the accuracy of any information on the website or that the accommodation is fit for purpose, safe and sanitary, or suitable for your specific needs. We do not warrant that the services provided will be uninterrupted, timely, secure or error free, or that any information, (including listings, feedback and guest books) provided on the website is error-free or reliable. 

1.4 No endorsement: We do not endorse any owner or any property, and we have no control over the suitability, quality or rental price of anything anyone advertises on our site. Each accommodation provider is solely responsible for any representation made in connection with their listing(s).

1.5 Right to modify or discontinue service: We may modify or discontinue this website, with or without notice to you. You agree that we will not be liable to you or any third party as a result of such modification or discontinuation. Easytour will hide or remove phone number, email address or URL in any posted on website content.


2.  OUR SERVICES:

We provide a venue to introduce potential short term holiday house guests ("guests") to house owners. Our service is not for the use of long term guests or those looking for permanent accommodation. We are not the agent of any owner listed on our website or of any guest, including where the online booking system is used. If a rental proceeds, you are entering into a rental agreement with the accommodation provider, not with us. 

EasyTour is engaged in providing quality O2O travel service to Chinese tourists, which is the fastest growing and second largest visitor market in New Zealand. We cooperate with Chinese largest travel merchants to have the house occupancy rate enhanced especially in off-peak seasons.

We are committed to providing high-end accommodation to our clients to attract the highly qualified and high-income visitors.

Vehicle rental is another feature of our service, and we welcome landlord who has the idle car to publish on the platform to get multiple incomes when leasing the house.


3. BECOMING A MEMBER

3.1 Rights to a membership: Anyone over the age of 18 years old can become a member of ours. By registering as a member you warrant that you can form a legally binding agreement. You are responsible for any actions taken through your membership. Memberships are non-transferable and cannot be sold, leased, let or traded.

3.2 Termination of membership: We reserve the right to remove memberships that are deemed non-active or have not been accessed for some time.  The members who didn’t listed their property in 60 days after registration would be removed from our database. We reserve the right to terminate your membership and use of the website if we believe you have violated or acted inconsistently with the letter or spirit of these terms and conditions, violated our rights, the rights of other members or any third party, or for any reason we see fit with or without notice to you.

3.3 Accuracy of information supplied: You warrant that you have provided complete, accurate and current personal information when registering as a member. We may phone, email or mail you to verify these details. You must not register as a member under multiple identities or personas whether false or not.

3.4. Security of your login information: You are responsible for keeping your login information (email and password) secure and secret. Without limiting the foregoing, you agree to not permit any other person to use your membership; and not to disclose, or provide information to others that would enable them to gain access to your membership.

3.5 Emails and newsletters: We reserve the right to send you emails related to your membership and any transactions you perform through the website. We may also send you periodic electronic marketing materials (e.g. newsletters), which you can opt out of receiving.

 

4. GENERAL RULES

4.1 RULES ON CONDUCT

4.1.1 Your conduct in using the website: All property listings, and all communications made through EasyTour must be made in good faith.

4.1.2 You must not damage, interfere with or harm the website of services, or any network, or underlying system part thereof, or attempt to do so.

4.1.3 You must not use a robot, spider, scraper or other automated means of accessing information from the website. You shall not attempt to access secure or non-public areas of the website without appropriate authorization.

4.1.4 Posting of any content (including feedback, guestbooks etc.): You are responsible for any content you provide to us and are responsible for the consequences of your posting such content.  By providing any content to us you warrant that you are the legitimate owner of this content and grant us non-exclusive, royalty free use of this content on the website and in any other marketing activities associated with promoting the website. You must not post materials that are copyrighted, unless you are a copyright owner or have the permission of the copyright owner to post it. Any images you upload must be “unmodified”, i.e. not digitally enhanced or modified in any way. This includes the addition of borders, arrows, outlines, logos, text or other enhancements. 

You shall not list your phone number, email address, name or URL in any posted website content (e.g. property detail page, feedback, guestbooks etc.). You must not post material that violates any law or infringes on any other intellectual property rights of others or on the privacy or publicity rights of others. You must not post content that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity. We reserve the sole right to determine what is considered offensive, defamatory or inappropriate language. You must not post sexually-explicit images.  You must not post or transmit advertisements, promotional materials, “junk mail,” “spam,” chain letters, pyramid schemes or any other form of solicitation. We reserve the right to edit or remove any content you supply for any reason we deem necessary.

4.1.5 Representation: You must not impersonate another person. You must not misrepresent your affiliation with any person or organization, or claim any endorsement you are not entitled to.

4.1.6 Non-solicitation: You must not solicit our members via the website for any products or services. Attempts to solicit our members may result in suspension or terminating of your membership at our discretion.


4.2 YOUR OBLIGATIONS AS A OWNER

4.2.1 You must comply with all laws relevant to the short term rental of the properties you advertise on our site. All information about your property and rates must be accurate at all times.

4.2.2 You will only list a property for rent if you are authorised to do so. If you are a co-owner of a property, you must ensure that all other co-owners agree to you renting out the property.

4.2.3 Each property you register on our website must represent an individual physical property.

4.2.4 You agree to respond to enquiries and online booking requests in a timely manner.

4.2.5 You must not place your contact details in the body of your listing.

4.2.6 You must list your accommodation prices in New Zealand dollars and include GST in the price (if there is). You acknowledge that your tax obligations are your responsibility.

4.2.7 Repeated failure to respond to booking requests may result in the removal of your listing. You may remove your listing from our website at any time.

4.2.8 Landlord and tenant responsibilities: 

        Once landlord has confirmed the order and tenant has completed the payment, landlord shall not temporarily increase the price or change description of the property. If need to, make sure complete the current order first, otherwise all the problems caused by the above, shall be taken by landlord;

        Once landlord has confirmed the order and tenant has completed the payment, if landlord want to decline the transaction due to personal reason, our system will automatically decrease the house grade and bad review from the tourist caused by above reason shall be taken by landlord.

        After the order confirmed and the payment been made, in accordance with Easytour cancellation policy “If the guest arrives and decides to leave early, 50% of the accommodation fees for the nights not spent after the cancellation occurs are refunded, no matter how many nights of the original reservation.” and “For all conditions, if guest cancelled within 24 hours of the scheduled start of stay, a cancellation charge amounting to 100% of the total booking charge is applied.” The guest shall bear the corresponding costs. The holiday rental owner shall return the rest of the payment back to the guest according to the policy.

        Under the Consumer Guarantees Act (click the link below for more information), situations that may be eligible for a refund generally fall into one of three categories: The host fails to provide reasonable access to the booked listing. The listing is misrepresented (ex: number of bedrooms, location, lacks promised amenities). The listing isn't generally clean, is unsafe, or there's an animal in the listing that wasn't disclosed prior to booking.

        If the holiday rental owner refused to refund the customer, the customer have cause to lodge a compensation claim against the holiday rental owner with the Disputes Tribunal (Ministry of Justice).


4.3 YOUR OBLIGATIONS AS A GUEST

4.3.1 While our site may show probable availability of some properties, it is not a guarantee that a specific property is available at a certain time. You must always check the availability by sending a booking request or contacting with the owners.

4.3.2 Owners may have particular requirements or restrictions on their properties. If so, these are a matter between the guest and the owner.


4.4 COMMENTS / FEEDBACK

4.4.1 The feedback or comments entries you provide on our website about users and properties must not contain offensive, defamatory, unlawful, misleading, deceptive or inappropriate language.

4.4.2 We are not responsible for any of the opinions expressed in the comment facility. By posting a comment you agree to take full legal responsibility and liability for your comments and to indemnify EasyTour from all liability, loss, damages, costs or expenses suffered by us in connection with your comment.

4.4.3 You may only give feedback related to a specific stay in a listed on our website that was either booked through the website, or was a result of an enquiry through the website.

4.4.4 You must not include any personal information in the feedback or guest books including but not limited to names, addresses, phone numbers and email addresses.

4.4.5 We reserve the right to remove any comments that it considers inappropriate or in breach of these terms and conditions.

4.4.6 Comments submitted to the website are provided for the sole purpose of facilitating the operation of the website and the services. You must not market or export any comments on the website to any other venue or website.

 

5. GUESTS MAKING A BOOKING

5.1 Terms of trade: Each accommodation provider is responsible for setting their own Terms of Trade (Rental Terms) - not EasyTour. It is up to you to ensure these are made available to you, and that you’ve read and understand them before you proceeding with any rental. We will not be held responsible for Rental Terms that are either not defined, are poorly defined (unworkable) or unfair.

5.2 Rent and Bond: Full payment is due at the time of submitting the booking request. The payment options guest could choose from include Visa card, MasterCard, UnionPay, Wechat Payment and ALIPAY. The bond will be refunded within 5 working days of the end of your stay provided that the property is left neat and tidy and in the same condition in which it was found; no items need repair or replacement; and there has been no other breach of these terms.

When you book an accommodation with a security deposit, your payment details are stored but not charged or authorised for the deposit unless the host makes a claim. The host has 3 days from your guest checkout date, or before the next guest checks in, to make a claim on the deposit for damages to their property.

5.3 Transaction fee: Guests will pay the bank transaction fee (equals 3% of the accommodation fee) when making the payments. Cleaning fee and bond won’t be charged for transaction fee.

5.4 Request processing: when you make a rental booking on our website, the request would be proceeded within 24 hours. Once the request is accepted, you would receive a confirmation email regards your booking request, the contact details of the accommodation provider of which property you booked, and the detailed information of your journey.

 

6. REFUND POLICY

   ●   Flexible

Flexible: FREE Cancellation 48 hours before check-in date. Cancellation received within 48 hours prior to the check-in 

date will incur 50% charge of the total accommodation fee.

   ●   Moderate

Moderate: FREE Cancellation 7 days before check-in date. Cancellation received within 7 days prior to the check-in date 

will incur 50% charge of the total accommodation fee.

   ●   Strick

Strict: FREE Cancellation 30 days before check-in date. Cancellation received within 30 days prior to the check-in date 

will incur 50% charge of the total accommodation fee.

If the guest arrives and decides to leave early, 50% of the accommodation fees for the nights not spent after the cancellation occurs are refunded, no matter how many nights of the original reservation.

For all conditions, if guest cancelled within 24 hours of the scheduled start of stay, a cancellation charge amounting to 100% of the total booking charge is applied.

 

7. TRAVEL ISSUES

7.1 Eligible travel issues

Situations that may be eligible for a refund under this policy generally fall into one of three categories:

        The owner fails to provide reasonable access to the booked listing.

        The listing booked is misrepresented (e.g. number of bedrooms, location, lacks promised amenities).

        The listing isn't generally clean, is unsafe, or there's an animal in the listing that wasn't disclosed prior to booking.

We will either provide you with a refund or use reasonable efforts to find and book you at another comparable accommodation for any unused nights left in your reservation. The amount of any refund will depend on the nature of the travel issue suffered.

7.2 Submit a valid claim for refund

To submit a valid claim for your reservation, you are required to:

         Contact us within 24 hours of check-in to document the issue, including photographs or other evidence of the issue as part of your claim.

         Be responsive to our requests for additional information and cooperation.

         Have not directly or indirectly caused the Travel Issue.

         Have used reasonable efforts to remedy the circumstances of the Travel Issue with the owner prior to making a claim, including messaging your owner to notify them of the issue. We'll verify this in your account.

  

8. FEES

8.1 Service Fees: It is completely free to register membership and list your properties on our website. We charge 10% of the total accommodation fee as the commission to owners when a booking request is successfully accepted, to promote your property on Chinese major social medias.

8.2 Processing the booking requests: When guests make booking requests, you should process the request within 24 hours from you are notified. You may either accept or decline the booking requests.

8.3 Acceptance: When a booking is confirmed, we will provide an acceptance notification email to the guest on behalf of the house owner.

8.4 Payments: After the payment has been made by the guest, the money will be kept as escrow in the account we trust; and then it will be transferred to the owner’s nominated bank account within 24 hours before the guest checks in, with a 10% deduction of the payment as commission at the time.

You are responsible for maintaining your bank account details and notifying us if they change. You agree to indemnify us against any bank charges or other costs that we may incur as a result of incorrect or out of date bank account information.

8.5 Decline: If owners decline the request, a cancelation notification email will be sent to the guests. No fees will be charged on booking requests that are declined or cancelled more than 48 hours prior to the scheduled start of the rental.

If owners had to cancel the booking within 48 hours prior to the start date of the stay, the fees equals to 50% of the first night rental will be charged to the owners (as the service fee) to comfort the guests and arrange another accommodation for the guests in a very short time.

8.6 Claim for refund: If a valid claim for refund has been submitted by your guests, the owner needs to refund according to the Guest Refund Policy.

We have the discretion to refund Commission charged on bookings on a case by case basis.

 

9. CAR RENTAL TERMS AND CONDITIONS

9.1 Parties

Each vehicle provider is responsible for setting their own rental conditions and requirements- not EasyTour. It is up to you to ensure these are made available to you, and that you’ve read and understand them before you proceed with any rental. We recommend the cars published on our website should all be covered with valid car insurance. We will not be held responsible for any disputes about car rentals.

The vehicles published on our website should be in safe and roadworthy condition, up to current Warrant of Fitness standards. The owner should ensure that the guest is aware of the details of the vehicle they rent and understand the Rental Agreement, including but not limited to the vehicle type, the rate, insurance policy, the guest’s obligations, cancellation conditions, refund policy, and patrol refuel.

9.2 Driving Licence 

As travelers:

You MUST carry your valid licence with you at ALL times when driving in New Zealand. If you have an International Driving Permit you must also carry your current and valid driver licence. If your overseas driver licence is not in English, you must carry an accurate English translation. If you need help with Driving License, please contact us.

9.3 Safe driving in New Zealand

We are committed to ensuring you have a safe and enjoyable driving holiday in New Zealand. Please make sure to read the Driving in New Zealand guide from the New Zealand Transport Agency and obey the rules when you drive in New Zealand.

9.4 Accidents

In the event of an accident the guest shall:

(a) Notify the owner of the full circumstances as soon as practical;

(b) Notify the NZ Police if the accident involves injury;

(c) Record full details of all parties, witnesses to and vehicles involved in the accident;

(d) If possible, prepare a written statement of the facts signed by all parties. If agreement can not be reached, obtain a copy of the Police report.

  

10. PRIVACY

We collect personal information about you through your use of the services and the website, including:

 your registration details; and information relating to your use of the services and website and the content you access.

10.1 You agree that we may use this personal information to assist us to provide the website and services to you, for internal research purposes, to verify your identity, to protect the rights, property, or safety of EasyTour Limited, our users, or others, for promoting and marketing our other services to you, and for any other use that you authorise.

10.2 We release account and other personal information only when we believe release is appropriate for legal compliance and law enforcement, to facilitate court proceedings; enforce or apply our terms and conditions; or protect the rights, property, or safety of EasyTour Limited, our users, or others.

11. GENERAL PROVISIONS   

11.1 System Integrity: We will make all effort to ensure availability of the website and services, subject to any downtime required for routine maintenance and upgrades. However, we take no responsibility for any system unavailability, or for any losses incurred as a result of the website or services being unavailable. Furthermore, we assume no responsibility for the corruption of any data or information held by us.

11.2 Governing Law: These terms and conditions are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the Courts of New Zealand.

11.3 Intellectual Property Rights: EasyTour (and its licensors or suppliers, as the case may be) owns all proprietary and intellectual property rights in the website (including text, graphics, logos, icons, video and sound recordings) and the software and other material underlying and forming part of the services and the website. You may not without our prior written permission, by any form or by any means adapt, reproduce, copy, store, distribute, print, display, perform, publish or create derivative works for any part of this website; or commercialise, copy, or on-sell any information, or items obtained from any part of this website.
